Booking Terms and Conditions

We are TripIcare, LLC. and are excited to help you with your travel. The following terms & conditions (the “Agreement”) describe what you can expect from us.
The terms “we”, “us”, and “our” refer to TripIcare, LLC. and the term “you” refers to the individual who signs this agreement. 
Quotes, Bookings, and Suppliers:  

 

  • Availability and price quotes are applicable to the date and time at which they are requested and cannot be guaranteed until the required deposit or full payment is made.

  • TripIcare, LLC. reserve the right to correct errors. All land and event offers are subject to availability and may change without notice. In the event of a land or event pricing error or omission, we reserve the right to adjust such pricing or make any other corrections.

  • Certain suppliers reserve the right to increase prices to cover increased costs, fuel surcharges, tariffs and taxes, and to reflect fluctuations in foreign exchange markets.

  • Quotes in a foreign currency fluctuate with exchange rates and international payments may carry a foreign transaction fee.

  • TripIcare, LLC. will make every effort to honor the price as originally quoted, however, under certain circumstances additional costs by a supplier or government may be imposed due to an increase in the cost for one or more of the travel components.

  • Flight confirmation is subject to availability and prices are subject to change after the date of deposit, including price increases in the fee for a seat assignment, fee for baggage, applicable fuel surcharges, or an increase in a government imposed fee or tax.

  • Once purchased, US air transaction prices will not increase, except for potential charges resulting from government imposed taxes or fees. I consent to pay for such charges and authorize TripIcare, LLC. to charge my credit card for such additional amounts.

  • Overperson shipping fees for documents shipped to client from TripIcare, LLC. may be billed to client.

 

Travel documents, Including TSA and DHS acceptable identification requirements:
  • It is the responsibility of the client to obtain and carry a valid passport, visa(s), driver’s license and all other documents required by applicable government regulations. TripIcare, LLC. recommends that all identification be valid up to six (6) months from the date of entry .

  • Correct legal names that match identification to be used for travel must be provided by the client to TripIcare, LLC. Name changes are not permitted on airline tickets. Clients are responsible for providing accurate information on Client Traveler Profile form. TripIcare, LLC. is not responsible for costs incurred by incorrect information provided for travel planning including reservations and airline tickets.

  • Children and infants also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/s/article/Article-3643 for additional information. The U.S. Customs and Border Protection Agency requires that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.

  • Client is responsible for making TripIcare, LLC. aware when traveling on a passport from a country other than the United States of America.

  • Final Travel Documents will be uploaded to the App and emailed to the Traveler no later than 14 days prior to departure. These documents include your daily itinerary, hotel and emergency contact information, and other relevant information.

 

Individual Entry and Exit Requirements:
  • Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements.   • We do not inquire about an individual’s criminal record, in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers.   • TripIcare, LLC. neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel.

 

Use of TripIcare, LLC. Services, Access, and Information for Travel Bookings:
  • TripIcare, LLC.  offers retail travel services to customers, which are provided by separate and independent vendors of travel services. TripIcare, LLC. does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that TripIcare, LLC. acts only as the agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that TripIcare, LLC. shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

  • You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with TripIcare, LLC. in accordance with all terms and conditions herein. You agree to be financially responsible for all of your travel bookings and warrant that all information supplied by you or members of your household transacting business with TripIcare, LLC. is true and accurate. Without limitation, any speculative, false, or fraudulent reservation is prohibited. You agree that the travel services provided by TripIcare, LLC. shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.

  • If for any reason your credit card charges are later declined, reversed, or TripIcare, LLC is unable to receive payment for the travel plans and services, you acknowledge that this is a binding contract between you and TripIcare, LLC. We shall be entitled to recovery, including reasonable attorneys’ fees in connection with collection.

 

Seller of Travel:
  • TripIcare, LLC. is an Independent Contractor of Nexion Travel Group, California Seller of Travel, [NUMBER} Florida  [NUMBER], Washington [NUMBER]. Registration as a seller of travel does not constitute approval by the State of California.

 

Payments, Changes, and Cancellations:
  • Unless otherwise defined during the reservation process, final payment is due prior to departure according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited.

  • All cancellation requests must be sent to TripIcare, LLC. in writing. As a result of cancellation, TripIcare’s and the third-party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, and each supplier’s Web site. We advise you of any cancellation penalties at the time of booking and provide information about these penalties upon confirmation. If you have any questions, or any penalties are unclear, please contact TripIcare, LLC.

  • TripIcare, LLC. charges a minimum of $250 per person cancellation fee for cancellation of any booking (this is a separate charge from any vendor cancellation fees, i.e. in addition to. Please see quote for vendor cancellation fees.).

  • All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier’s refund. The cancellation fee must be paid at the time the Client initiates cancellation of any trip  that has been booked in full, or in part, without regard to whether the booking is within the final payment window.

  • As TripIcare’s tour or package prices are based on its suppliers’ contract rates, there will not be any refund for any unused portion of a tour. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. Any cancellations of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy.

  • Flight Changes - see below​

Force Majeure:
  • “Force Majeure” means, in relation to TripIcare, LLC. any circumstances beyond the reasonable control of TripIcare, LLC.  (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, pandemic, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).

  • TripIcare, LLC. shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.  TRIPICARE, LLC. CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY.

  • If TripIcare, LLC., and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by TripIcare to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although TripIcare, LLC. shall use its reasonable efforts to secure reimbursement for you where possible. However, TripIcare, LLC. shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to TripIcare, LLC. of the Force Majeure and applicable cancellation fees.

  • Regarding civil unrest, once TripIcare, LLC. has investigated the prevailing situation, as it deems fit, it shall remain in TripIcare, LLC’s sole and absolute discretion whether to proceed with any  escorted trip or private departure. You may in such circumstances cancel the trip subject to TripIcare, LLC’s and each supplier’s terms and conditions.

 

Travel Insurance (Protection): 
  • We offer access to Travel Insurance to protect passengers and their investment in travel. Unless specifically noted, travel protection is not included in the cost of client itinerary to protect against third party supplier default/bankruptcy protection, delay, interruption, missed connection for cruises, cancellation, medial emergency transportation/evacuation & repatriation, baggage & personal effects/lost luggage & baggage delay, illness, job loss protection and change of plans, accidental death and disability, travel accident/sickness medical expenses, and more. However, proper insurance may protect you from financial loss in almost all circumstances.

  • Without appropriate travel insurance, Client understands and agrees that if Client cancels or interrupts Client’s travel for any reason, portions of the trip/tour may not be refunded and TripIcare, LLC.’s and travel suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Client’s travel booking and related costs.

  • The purchase of travel insurance is not required in order to purchase any other product or service offered by TripIcare, LLC.  We are not licensed insurance brokers, and our advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected.

 

General: 
  • The laws of the State of Pennsylvania govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Pittsburgh, Pennsyvlania in all disputes arising out of or relating to travel bookings with TripIcare, LLC.

  • If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

  • These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and TripIcare, LLC. with respect to travel bookings made with TripIcare, LLC. by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and TripIcare, LLC. with respect to communications with TripIcare, LLC.

  • A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
